In the 2024 election, a proposal to amend Florida’s constitution to include abortion rights failed to pass. Since then, the state’s existing abortion laws remain in effect. Knowing what these laws mean is key to knowing your pregnancy options and what is required in the state of Florida.

A Six-Week Abortion Ban

The Heartbeat Protection Act in Florida prohibits abortions after six weeks of pregnancy, except in cases where the mother’s life is at risk, or the fetus has a fatal abnormality. This means that most abortions must be done before a detectable heartbeat, which could be as soon as six weeks.

It’s also important to note that the state of Florida requires parental consent for any woman seeking abortion under 18 years old. This adds an extra step for minors, requiring a parent or legal guardian to provide written approval before the procedure.

Telemedicine is Prohibited for Abortion

The abortion pill (also known as medical abortion) cannot be prescribed online by law. Florida prohibits telemedicine for all abortion services, and physicians must dispense drugs for medical abortions in person.

This new Florida policy requires women who want a medical abortion to visit a clinic in person.

24-Hour Waiting Time & In-Person Appointments

Another important new abortion Florida law requires a mandatory 24-hour waiting period between an abortion consultation and the actual abortion procedure. Women will need to go to two separate in-person appointments:

  1. The first appointment includes lab work, an ultrasound, educational resources, and a consultation with a physician.
  2. The second appointment is when the procedure is completed (at least 24 hours after the initial visit).
